BABA SUWE RELEASE

LAGOS - A court in Ikeja high yesterday ordered the Drug Control Act National NDLEA to release the popular comedian, Mr. Babatunde Omidina, alias Baba Suwe Friday if no drugs n 'was found on him even though the actor told the court that the detention was removed 15 times during his 21 days in the custody of the agency, but found nothing.


The court ordered the agency to produce anti-drug Baba Suwe in court yesterday in a motion filed by his lawyer, Mr. Bamidele Aturu. He was arrested by officers of the NDLEA at Murtala Muhammed Airport in Lagos on October 12 on the road to Paris, for allegedly suspected drug intake.

Following a request for his release by his lawyer, the court accepted that bail in the sum of N500, 000 with a guarantee for the same amount, while the security situation and address must be verified by the Registrar General of Court.

Baba Suwe international passport with the NDLEA must be submitted to the Secretary-General pending the determination of the combination of substance, while the bonus will be an absolute effect on Friday, November 4th, if not excrete suspected narcotics.

Rule on the bail application of the humorist, the Court reiterated that freedom of the applicant had been flagrantly violated, adding that there was no higher order to the constitution.

"It is due to immediate release. I grant him bail and if there is a development, it must inform the court," the court ruled.
The trial judge, Justice Yetunde Idowu, however, wanted to know how Baba Suwe was treated in custody and the following exchange occurred:
Court: Baba Suwe how are you?
Baba Suwe: I'm fine.
Court: Do you abuse?
Baba Suwe: None
Court: Do you eat?
Baba Suwe: Yes, I do not like, but with my money. They put the food at 11 hours and when I have hunger, I use my money to buy food and have removed 15 times, but found nothing. "
Baba Suwe advisor, Mr. Bamidele Aturu, had argued that the applicant's arrest and detention is illegal and contrary to the Constitution of the country, adding that the NDLEA has no case and violates the fundamental rights of his client.
"The agency did not make the Federal High Court for a warrant and was nine days after he was arrested and served with judicial process.
We believe that the period from October. 12 to 21, 2011, when the order was obtained was not heard, the court should consider detaining the applicant is a blatant disregard and deliberate violation of their fundamental rights to freedom, "he argued.
Aturu added that the court must send a strong signal, so these are not repeated and continued detention of the applicants on the basis of contradictory and inconsistent amount to a judicial approval.
NDLEA lawyer, Mr. Femi Oloruntoba, who opposed the application Suwe Baba said that he was arrested on the basis of suspicions that ingested drugs and had been subjected to different analysis.
Oloruntoba note that the first analysis, an assessment of NCCT in the abdomen and pelvis revealed that there were several nodular hyper-dense particles in the gastrointestinal tract, consistent with a large amount of drug ingestion, but the nature of the drugs are relevant laboratory tests.
He said ultimately, the result showed "that the foreign body now moves to the bottom of the upper abdomen and is a matter of time before being removed", but could not give the correct time.
He argued that the applicant was detained in accordance with the NDLEA Act, adding that took advantage of Article 35 (5) (b) of the Constitution
Baba Suwe in its application to fundamental human rights filed against the NDLEA had asked the Court to declare that his arrest and detention since October 12 the agency was a flagrant violation of basic human rights.
He had asked N100million compensation and a public apology in the pages of two national newspapers notable.
